Beta Program Terms

Introduction

These Beta Program Terms ("Beta Terms") govern your participation in SUZKO's beta programs, early access features, and preview releases. By participating in any beta program, you agree to be bound by these terms in addition to our standard Terms of Service.

1. What is a Beta Program?

Beta programs provide early access to new features, services, or products that are still under development. Beta features may be labeled as:

  • Alpha: Early-stage features with limited functionality
  • Beta: Features approaching completion but still being tested
  • Preview: Features ready for broader testing before general availability
  • Early Access: Limited availability features offered to select customers

2. Eligibility and Enrollment

2.1 Who Can Participate

To participate in beta programs, you must:

  • Have an active SUZKO account in good standing
  • Agree to these Beta Terms
  • Meet any specific requirements for the beta program
  • Be willing to provide feedback and report issues

2.2 Invitation and Access

Some beta programs are open to all customers, while others are invitation-only. We may invite you based on:

  • Account history and usage patterns
  • Technical requirements and use cases
  • Capacity constraints for the beta program
  • Geographic location or service tier

We reserve the right to accept or reject participation at our sole discretion.

3. Beta Features and Expectations

3.1 Nature of Beta Features

You understand and acknowledge that beta features:

  • Are experimental and under active development
  • May contain bugs, errors, or incomplete functionality
  • May change significantly or be discontinued at any time
  • Are not covered by our standard SLA
  • May not be suitable for production use

3.2 No Guarantees

We make no guarantees that beta features will become generally available, maintain current functionality, or meet your specific needs. Features may be modified, delayed, or cancelled without notice.

4. Your Responsibilities

4.1 Testing and Feedback

As a beta participant, you agree to:

  • Actively test beta features and explore functionality
  • Provide honest, constructive feedback through designated channels
  • Report bugs, issues, and unexpected behavior promptly
  • Respond to surveys or requests for feedback
  • Participate in interviews or user research sessions when invited

4.2 Appropriate Use

When using beta features:

  • Do not rely on beta features for production-critical workloads
  • Maintain backups of any data used with beta features
  • Expect potential service interruptions or data loss
  • Follow any specific guidelines provided for the beta program

5. Confidentiality

5.1 Confidential Information

Unless explicitly stated otherwise, all beta programs and features are confidential. You agree not to:

  • Publicly disclose or discuss beta features without authorization
  • Share screenshots, documentation, or demos of beta features
  • Benchmark or publish performance data about beta features
  • Share your beta access with others

5.2 Duration of Confidentiality

Confidentiality obligations remain in effect until the feature is publicly announced or we notify you that confidentiality is no longer required.

5.3 Exceptions

Some beta programs may be designated as "public beta," in which case the confidentiality restrictions above do not apply. This will be clearly communicated when you enroll.

6. Intellectual Property

6.1 Our Rights

All beta features, including code, designs, and documentation, remain our exclusive property. Your participation in a beta program does not grant you any ownership or license rights beyond what is necessary to test the features.

6.2 Your Feedback

By providing feedback, suggestions, or ideas about beta features, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate that feedback into our products and services without compensation or attribution to you.

7. Data and Privacy

7.1 Beta Data Collection

During beta programs, we may collect additional data about your usage to improve the feature, including:

  • Usage patterns and feature adoption
  • Error logs and crash reports
  • Performance metrics
  • Feedback and survey responses

7.2 Data Loss Risk

Beta features may experience data loss, corruption, or migration issues. We are not responsible for any data loss that occurs during beta testing. Always maintain independent backups of any important data.

8. Liability Limitations

To the maximum extent permitted by law, we disclaim all liability for:

  • Any damages arising from your use of beta features
  • Data loss, corruption, or security breaches in beta features
  • Business interruption or lost profits due to beta feature issues
  • Third-party claims related to your use of beta features

Beta features are provided "AS IS" without warranties of any kind, express or implied.

9. Termination

9.1 By You

You may opt out of any beta program at any time by disabling the feature or contacting support. Opting out may result in loss of access to beta functionality.

9.2 By Us

We may terminate your beta participation at any time if you:

  • Violate these Beta Terms or our Terms of Service
  • Breach confidentiality obligations
  • Fail to provide adequate feedback or engagement
  • For any other reason at our discretion

9.3 Beta Program Conclusion

When a beta program ends, the feature may be released generally, require migration, or be discontinued. We will provide guidance on next steps.

10. Incentives

Some beta programs may offer incentives for participation, such as extended free access, discounts, or exclusive features. Incentive terms will be communicated when you enroll and are subject to their own conditions.

11. Changes to Terms

We may update these Beta Terms at any time. Continued participation in beta programs after changes are posted constitutes acceptance of the revised terms.

12. Indemnification

You agree to indemnify, defend, and hold harmless SUZKO, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your participation in any beta program, your use of beta features, your breach of these Beta Terms or our Terms of Service, your violation of any confidentiality obligation, or any third-party claim arising from your use of beta features or the data you process with them.

13. Governing Law

These Beta Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles, consistent with our Terms of Service. Any dispute arising out of or relating to these Beta Terms will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Indiana, and you consent to the personal jurisdiction of those courts.

14. Severability and Entire Agreement

If any provision of these Beta Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Beta Terms, together with our Terms of Service and any program-specific terms communicated at enrollment, constitute the entire agreement between you and SUZKO regarding your participation in beta programs and supersede all prior or contemporaneous understandings on that subject. Our failure to enforce any provision is not a waiver of our right to do so later.
